PREAMBLE
The customer acknowledges having read the general conditions of sale hereafter. The validation of your purchase order by clicking on "confirm my order" will be worthy of full acceptance of these general conditions of sale. As of the acceptance click above, the order is considered irrevocable and can not be called into question.
 
CONDITIONING UNIT
Given the packaging constraints, we remind you that the control unit must be understood by bottles. (Except gift boxes).


Article 1: Price France / Europe
 
1.1 Regarding shipments in France, the prices of our products are indicated in euros (EUR), French taxes included (TVA) except participation in processing and shipping costs (see "Delivery").
 
1.2 Shipments made in any other Member of the European Union shall also be subject to VAT at the rate in force in the country of sale (Article 256 - 256 bis CGI).
 
1.3 For any shipment to a country other than Metropolitan France or a Member of the European Union, you are the importer of the product (s) concerned. Customs duties or other local taxes or import duties or state taxes are likely to be due. These rights and sums are not the responsibility of Escuminac. They will be at your charge and are entirely your responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to learn about these aspects from your local authorities.
 
America - Canada / United States
1.4 For shipments to Canada prices are in Canadian Dollars (CAD $). For shipments to United States prices are in American dollar (USD) The federal tax, provincial tax (if applicable), shipping costs and taxes applicable to shipping costs are added to the base price. Any other costs that may result from international carriage from the country concerned, such as customs duties, entry fees and customs brokerage are at the customer's expense (if applicable).
 
1.5 Escuminac reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in effect at the time of the registration of the orders.
 
 1.6 The products remain the property of Escuminac until full payment confirmation.

Article 2: Order
After placing your order, you will receive a confirmation via email, and a detailed invoice. Escuminac reserves the right to cancel or refuse any order from a customer with whom there is a dispute or problem relating to the payment of a previous order.
 
Article 3: Validation
You declare that you have read and accepted these Terms and Conditions before placing your order. The validation of your order therefore constitutes acceptance of these General Conditions of Sale.
Your order will only be confirmed after payment has been made online.
No payment at delivery is possible.
 
Article 4: Availability
Our product offers and prices are valid as long as they are visible on the site, within the limit of available stocks.
 
In case of stock shortage, we will contact you by email or telephone, in order to agree an arrangement.
We offer you an exchange for the same amount as the unavailable item, an asset, a refund, or wait for the replenishment of the latter. We do not send orders in several installments.
 
Article 5: Delivery
France / Europe
5.1- Conditions: The products ordered are delivered to the address indicated by the customer. The parcel will be forwarded to the consignee through our usual transport provider or in any case by a service provider of our choice. In particular, the customer is responsible for checking the condition of the packaging and the contents of the package (s) upon delivery, approximating the quantity and reference delivered from the order form. The signature of the receipt of deliveries will carry acceptance of the customer. The customer is obliged to inform the company Escuminac within 48 hours after receipt of the parcel of any damage caused by the transport.
 
5.2- Delays Metropolitan France: The average delivery time in standard service is 4 to 5 working days, from the reception of the order (Monday to Friday, order placed before 13:00). For the holiday season, allow 8 to 10 days for delivery.
 
Deliveries are possible only in France and Europe. We do not deliver DOM-TOM.
 
5.3- Delays Canada: The average delivery time in standard service is 4 to 5 working days, from receipt of the order (Monday to Friday, order placed before 13:00). For the holiday season, allow 8 to 10 days for delivery.
 
5.4- Delays United States: The average delivery time in standard service is 6 to 8 working days, from receipt of the order (Monday to Friday, order placed before 13:00). For the holiday season, allow 10 to 15 days for delivery.
 
Except in cases of force majeure, delivery times will be, within the limits of available stocks, those indicated above.
 
These periods exclude Saturdays, Sundays and public holidays. All orders placed will be processed from Monday to Friday until 13:00, excluding public holidays. This period is guaranteed and may, in the event of non-compliance, be refunded. For the standard service, delivery takes place from Monday to Friday (excluding holidays and non-working days).
 
Delay: We will do our best to have your shipment delivered according to our usual delivery times. Nevertheless, if we were unable to satisfy you, we inform you that in no case the refund of the product can be demanded to the company Escuminac and that only the delivery service can, subject to the reservations issued in paragraphs 5.1, be reimbursed.
5.5- Circumstances beyond our control. We can not be held liable for losses, damages, errors or defects in delivery of a shipment if circumstances beyond our control are established. "Circumstances beyond our control" shall include:
- fortuitous events or force majeure, namely: earthquakes, cyclones, storms, floods, wars, road accidents, train and aircraft accidents, embargos ...
- any defects or peculiarities related to the nature of the shipment even if it would have been known to us at the time of our acceptance,
- any act, defect or negligence of any third party, for example: the consignor, the consignee, any interested third party, any customs or other administration employee, postal services, any carrier or other third party to whom Entrusted by our transport provider, to serve sectors not served directly by itself, even if the sender has not requested or been informed of the use of a third party.
 
Similarly, we are not responsible for any damage caused by electrical or magnetic phenomena and / or erasure of electronic or photographic images or recordings.
 
5.6- Indirect damage. In the event of non-compliance with our commitments and for any reason whatsoever, Escuminac will only be obliged to reimburse the delivery service under the aforementioned reservations (Delay of Delivery) and in no case Of the indirect damages that the customer would have to invoke. Such indirect losses and losses include, but are not limited to, any loss of income, profits, interest or market, and any loss arising from the inability to use all or part of the shipment.
 
5.7- Break during shipping. If a parcel arrives damaged. (breakage of bottles), the consignee must refuse the parcel. The carrier will inform Escuminac. Upon receipt of this information, Escuminac undertakes to re-send to the consignee immediately an identical package. Under no circumstances will the customer require the refund of the product and the delivery package.
 
5.8- Availability of products. All the products offered are available in stock. Nevertheless, given the specificity of the products offered, we are not always able to replenish our suppliers. Our offer is therefore within the limit of available stocks and exceptions reported.
 
The updating of our product database is in principle regular. Nevertheless, available displayed products may not be available at the time of processing your order. Consequently, the customer expressly discharges the company Escuminac from all responsibilities due to the constraints cited above.
 
Therefore, if the products ordered are available, your order will be processed according to the conditions listed above.
 
If the products ordered are not available on the day of processing your order, but can be replenished, they will be shipped as soon as they are placed in stock.
 
If the products ordered are not available in stock at the time of processing your order and can not be replenished, we will inform you of the situation by post, e-mail or telephone.
 
5.9- Degradation of product quality. In no event shall Escuminac be held liable for degradation of the quality of products and their packaging caused by transport.
 
5.10 - Warsaw Convention. If the transport of the consignment includes a final destination or stopover in a country other than the country of origin, the Warsaw Convention may be applicable. In the event of damages outside the French or European borders, this agreement will govern the relationship between the customer and Escuminac.
 
5.11- Delivery address. If the parcel is returned to Escuminac on the grounds of "incomplete address" or "false address", Escuminac undertakes to contact its customer to inform him of the situation and request further information on the address or a new one shipping address. The cost of this redirection shall be borne by the customer. Of course, in this situation, the starting point of the new delivery period will be linked to the receipt by Escuminac of new information concerning the new address.
 
5.12- Delivery rates: For France and the rest of the European Union, prices are in Euros, all taxes included. For Canada rates are in Canadian dollars (CAD) and for the United States, rates are in american dollars (USD) excluding taxes.
 
Article 6: Payment
The payment of your purchases is made:
By credit card: Carte Bleue (CB), Visa or MasterCard (secure online payment from Credit mutuel and Caisse Desjardins) You will then need 3 data: the 16 digits of your credit card, the expiry date and the cryptogram on the back. No payment by check will be accepted.
 
 Article 7: Security
In order to optimize the security of transactions on INTERNET, the online payment system offered to the customer allows to encrypt all the data relating to his orders (including his name, address and credit card number). The information thus communicated is protected during transmission. For payments in France and Europe, Crédit Mutuel is our partner. With respect to payments in Canada and the United States, the Caisse Desjardins assumes the levies.
 
In addition, the means and services of cryptology used to secure the transactions have been subject, as the case may be, to a declaration or authorization in accordance with the legislation in force.
 
Article 8: Right of withdrawal
You have the right of withdrawal of fourteen (14) days from receipt, provided for by law, to return the items to us without having to justify reasons. The cost of return will be at your expense, and only the price of the product (s) purchased will be refunded within fourteen (14) days. You must first contact our after-sales service. Items returned incomplete, damaged, damaged or soiled by the customer are not taken back.
 
Article 9: Conformity of products
We promise to refund you by bank return or to exchange you the products not corresponding to your order. In this case, we kindly ask you to contact the after-sales service to inform us in detail by e-mail accompanied by at least one color photograph.
 
Escuminac will decide to exchange, compensate or refund the product (s). The request must be made within fourteen (14) days of delivery. Any complaint made outside this period can not be accepted. In the event of an error on our part, Escuminac will decide to send you a Colissimo return label at its own expense to exchange or refund the item not received. In the event of forgetfulness on our part, Escuminac will decide either to return you the missing item (at its expense), or to refund it to you in the form of a credit note. The provisions of this article do not prevent you from benefiting from the right of withdrawal (satisfied or refunded) provided for in article 8.
Finally, in case of product deteriorated by the transport, Escuminac undertakes to take all the necessary steps with your carrier to obtain the refund of the products. In this case, please attach 3 photographs: Package with visible label, the product in its original packaging and the deteriorated product.
 
Article 10: Reimbursement
Reimbursements of products under the assumptions referred to in Articles 8 and 9 shall be made within a period not exceeding fourteen (14) days after the receipt of the products by us. The refund will be made at the option of Escuminac by credit to your bank account or by bank check sent to the name of the customer who placed the order and to the billing address. No consignment for cash will be accepted for any reason.

Article 12: Liability
The products offered comply with the legislation in force. Escuminac can not be held liable for non-compliance with the legislation of the country where the products are delivered. It is your responsibility to check with the local authorities the possibilities of importing or using the products you plan to order. The photos are provided for illustrative purposes only. We invite you to refer to the description of each product to know the precise characteristics. Do not hesitate to contact us in case of doubt or if you need further information.
Article 13: Protection
The elements contained on this site, in particular the texts, illustrations and photographs can not be the object of any use, modification, alteration, partial or total reproduction and more generally of any exploitation without the express agreement of the company Escuminac .
 
Article 14: Applicable law
This Agreement is subject to Canadian law. The language of this contract is English. Any dispute shall be within the exclusive jurisdiction of the Tribunal de Commerce de Québec, the sole competent court, irrespective of the place of dispatch.
